yes, it is legally justifiable but not morally. they are enjoying family legacy in Indian government by using the Gandhi surname. Majority of Indians are fool in the way that they are always voting them to power so that our country can be ruined. Nehru family has given us price-rise, corruption, confused foreign policy and so on.
